Terms & Conditions - These Terms & Conditions Apply To Orders placed on NessaLeeBaby.com and in any NessaLee Baby location.
Please read the below Terms and Conditions carefully before submitting your order.
1. You agree that you are providing NessaLeeBaby.com with accurate credit card information at the time of submitting your online purchase order. You represent and warrant to NessaLeeBaby.com that your use of the submitted credit card is authorized and legal.
2. Once you submit your order, you have agreed to the pay the charges as they appear in your cart, including applicable shipping and sales tax. No changes can be made to your order or pre-order once it is submitted. This includes, but is not limited to: price, address, shipping, cancellations and credit card information.
3. NessaLeeBaby.com reserves the right to deny the use of any promotional codes or coupons.
4. Pre-ordered items are not in stock. By purchasing one of these items you are reserving one for yourself when they arrive at NessaLeeBaby.com. NessaLeeBaby.com makes an effort to give an estimated date of arrival, but makes no guarantee of the date of arrival and shipment. Pre-orders cannot be canceled once they are placed. In the event that a cancellation exception is made, it will be based on circumstance (ie: if the item shipped already, how far into production it is, if our store is unable to cancel it with the manufacturer). This request must be submitted in writing. It is manager's discretion and if a cancellation is approved, an email confirmation will be sent to the customer. At that time a store credit for the full amount will be issued, or a 20% re-stocking fee will be deducted from the refund.
5. By submitting a pre-order you are authorizing that these funds are available and that NessaLeeBaby.com is permitted to immediately bill the charges with any pre-approved shipping charges and taxes.
6. If a pre-order is submitted with an in-stock item and you wish to ship both items together, the in-stock item will be held and billed immediately with all appropriate shipping charges and taxes where applicable.
7. NessaLeeBaby.com does not offer any price adjustments or changes in the billing method on prior purchases, no matter the length of time between the submission of the order and contact with a NessaLeeBaby.com representative.
8. If your order is rejected due to inaccurate credit card information, insufficient funds or any other reason, your individual bank may hold the funds. It is not NessaLeeBaby.com holding the funds and NessaLeeBaby.com is not responsible / able to release them. You must contact your banking institution directly.
9. Returns and exchanges are accepted on unworn, unaltered, unwashed, unopened, unassembled and unused items that have all original tags attached and are in their original packaging. You may exchange or return merchandise by mail within 15 days of receipt of purchase once you receive a Return Authorization Number. This number must be written visibly on the outside of your return. Once we receive and inspect the item you will be refunded, minus the shipping and handling charges. All merchandise sold at a 20% or greater discount is considered a clearance sale. This includes items on sale for this amount or items that are sold for a 20% or greater discount due to the use of special coupons and promotions. Clearance items are final sale. If your order received Free Shipping, but you return one or all of the items which would make your new order total not eligible for Free Shipping, you will receive a credit minus the appropriate shipping charges (what it cost NessaLee Baby to ship your item).
Any return or exchange without a return authorization will be refused and returned to sender at the sender's expense. No exceptions will be made. In order to obtain an RA# please call or email us at RA@NessaLeeBaby.com with your name, date of purchase, item you would like to return or exchange and reason. Once you receive your RA# your items must still be sent back in the permitted time period and your RA# must appear clearly and visibly on the outside of your package.
In the event that the wrong RA# is provided by the customer or the return is opened by NessaLee Baby, but does not meet the requirements, it will either be shipped back at the customer's expense or a store credit will be issued (depending upon the return). In the rare case that an item is returned and accepted, after the allowed period of time, the customer will receive the lowest selling price in the form of a store credit. The lowest selling price includes the price currently listed on our site, plus any valid and possible coupons.
10. Items that are final sale are not returnable or exchangeable.
11. All furniture, assembled items, mattresses and special and custom orders are final sale, no matter the length of time between purchase and attempted exchange or return. These orders cannot be returned, exchanged or canceled at any time. Should a situation arise where NessaLee baby is able to cancel an order, the customer will be responsible for 20-50% of the charge, depending upon the manufactures guidelines and our specific policy for that product. If you have any questions about the specifics of a brand's cancellation / re-stocking fee, you must ask prior to placing your order. If requested, you will receive specific information on the cancellation fees that apply to your chosen items prior to purchasing. Once the order is placed, the terms have been agreed to and NessaLeeBaby's policies apply.
12. Returns that do not meet NessaLeeBaby.com’s requirements will be sent back to the buyer at the buyer's expense.
13. Any item paid for with a store credit or gift certificate will receive the credited amount in the same form.
14. When returning or exchanging an item, all shipping costs are the responsibility of the customer.
15. NessaLeeBaby.com cannot be held responsible for returned items that do not arrive back to us. It is the responsibility of the customer to arrange for tracking, insurance and delivery confirmation. In the event that the return is not received or received in damaged condition, NessaLeeBaby.com will not issue a refund, credit or exchange. In order for the customer to recoup the losses, it is their sole responsibility to file a claim with their chosen delivery service.
16. If you receive a defective product from NessaLeeBaby.com, you must notify us in writing (via email) within two days of receiving the product to be eligible for a return or replacement.
17. Any package refused by a customer will be billed the shipping charges upon receipt of NessaLee Baby.
18. All returns are only eligible with a valid Return Authorization number (RA#). In order to obtain an RA# the customer must call or email NessaLeeBaby.com They must include the name on the order, date of purchase, brand name, item name, size and color (if applicable), as well as the reason for return or exchange. Once an RA# is issued, the customer must send back the item(s) approved for return/exchange in the permitted time period and the RA# must appear clearly and visibly on the outside of the package.

The lowest selling price includes the price currently listed on our site plus any valid and possible coupons that may or may have not been used at the time of purchase.
20. Purchased items where only a deposit is placed is defined as “layaway”. This secures an item for a customer to be paid off at a later date. Items on layaway are purchased by NessaLee Baby for the customer and then held out of inventory for the customer. Layaway items are not returnable. Layaway payments are not refundable. Should a customer choose not to complete the remainder of the purchase, the money paid as a deposit will not be refunded to the customer. Requests to cancel must be submitted in writing (email). It is manager's discretion on whether to approve a cancellation. An email confirmation will be sent to the customer confirming that the request was received. If the manager approves the cancellation another email will be sent to the customer outlining the manner of the refund. Either a store credit for the full amount will be issued, or a 20% re-stocking fee will be deducted from the item’s original full price as a refund. If the total paid amount is less than 20% of the item’s original retail price total – no funds in any form will be issued to the customer. Layaway purchases can be paid off at any time and picked up at any time. Layaway is valid for a period of 6 months. At 5 months, the customer will receive an email letting them know they are approaching the 6 month mark and payment must be made in full. If they choose not to make payment, the item will be un-held and considered a cancellation where either a store credit will be issued for the full amount or a 20% re-stocking fee from the item's original price as a refund. Any questions regarding the process should be submitted in writing prior to making a purchase. Otherwise, it is understood that all parties agree to the terms & conditions.
21. NessaLeeBaby.com’s online shopping services are provided on an ‘As Available’ basis and NessaLeeBaby.com does not provide any assurances of the availability or usability by you of the online shopping services.
22. NessaLeeBaby.com provides no additional warranties of the products sold. Items that are warrantied by the manufacturer and have problems after use are to be reported by the customer directly to the manufacturer. When possible, NessaLeeBaby.com will make every effort to help our customers with warranty issues. When applicable, it is strongly suggested that customers register their products with the manufacturer immediately after purchasing them at NessaLeeBaby to be covered by their manufacturer warranty.
23. The products sold at NessaLeeBaby.com are all guaranteed to be manufactured by the brand as stated. Information regarding all products is described to the best of NessaLeeBaby.com knowledge. In no way is NessaLeeBaby.com responsible for any assumptions made by the customer with regard to the product.
24. Photographs that do not feature NessaLeeBaby.com models have been pulled from public sources only to show a particular item or brand. Any likeness to celebrities and public figures does not imply any endorsement by that person of any item or brand.
25. NessaLeeBaby.com uses a 3rd party delivery service and makes no guarantee regarding time or date that items are delivered, for general shipping. This does not include guaranteed services.
26. If you become aware of any unpaid sales taxes or other amounts with respect to any purchases, you must expeditiously report this to NessaLeeBaby.com and you must timely pay such taxes or amounts.
27. NessaLeeBaby.com has the right to deny service to anyone, with or without cause or reason.
28. Limitation of liability. NessaLee Baby shall not be liable to you for any interception of online communications, software or hardware problems (including, without limitation, viruses, loss of data or compatibility conflicts), unauthorized use of your credit card, or other consequence beyond the reasonable control of NessaLee Baby.
29. These Terms and Conditions and the order form, collectively constituting the sole and entire agreement between NessaLee Baby and you regarding the online shopping services, are governed by laws of the State of New Jersey.
30. It is your responsibility to review the Terms and Conditions prior to submitting each order and NessaLee Baby has no responsibility to notify you of any changes prior to effectiveness of the changes or otherwise.
31. NessaLee Baby reserves the right to, with or without notice to you, amend the Terms and Conditions for use and purchases regarding the online shopping services. Any amendments by NessaLee Baby will be effective only as to orders you place subsequent to NessaLeeBaby.com.
32. These Terms and Conditions, as amended from time to time, shall be the sole terms of the agreement between you and NessaLee Baby regarding your online purchases. All statements otherwise made on the web site are intended only for your convenience.
Terms and Conditions are the agreement between you and NessaLeeBaby. By checking the box on our Checkout page you confirm and affirm that you have read, understood and agree to the Terms and Conditions and our legally bound to our policies.
